Service of Process Fees
APS/CAG fees are for work performed, even if we are not able to serve the defendant.  APS/CAG charges for each two (2) attempts.  Fees are subject to change without notice.  After two unsuccessful attempts at service at the same address, APS/CAG will call you for authorization of additional work or instructions.  Additional attempts are at the same rate, and APS/CAG will bill you.

No Refund
No refund will be made for failure to serve, copy or file because of inadequate or ambiguous instructions, improper documents supplied, incomplete documents supplied, the unavailability of the party at the time of service, or inadequate or incorrect address.

Instructions
Remember, APS/CAG servers are not lawyers. If you are sending state papers and your rules are different from the Federal Rules, you should consult the State Rules and notify us of the methods and requirements for service.

Cancellation
The minimum cancellation fee for any service is $20.

Courier
When sending your documents for service to any APS/CAG location, send documents via Federal Express or other over-night courier service or send your documents electronically using our Order Form.  Fee Schedules do not include courier charges.

Proof
Proof of service will generally be returned by U.S. mail within 14 days. (Applies to US service of process only, not international service of process.) If you do not receive your proof of service within 14 days of when APS/CAG received your documents, please call us toll free and we will check the status at no charge to you.

Warranty And Disclaimer:
LIMITATION OF LIABILITY-APS' LIABILITY FOR LOSS, DAMAGE, DELAY, NON-DELIVERY OR MISDELIVERY OF A SERVICE SHALL BE LIMITED TO THE ACTUAL VALUE OF SUCH SERVICE.  In the event that any APS service is determined to be improper for any reason, APS will refund to the customer all charges for those particular services. This sum shall be complete and not as a penalty.  IN NO EVENT SHALL APS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES that may arise from the loss, damage, delay, non-delivery or mis-delivery of any service.  This limitation shall apply to and include, but not be limited to, damages for loss of profit, loss of income or a loss of bargain.  Due to the nature of the business, APS will not be liable, except as provided herein, for failure to deliver by a stipulated timely date.

Account Terms:
To be eligible for an account with CAG your firm must be a Corporation, Partnership, LLC , LLP, Government, Government Subdivision or Agency, Joint Venture, Cooperative, or Association

User Liability for Payment:
Persons using APS services acknowledge and agree that APS may look to their personal pledge of credit for additional work performed, notwithstanding that they are acting as agents for known principals.

Payment Terms
Unless prior credit arrangements have been made, all invoices are due and payable upon receipt. The Firm/Company who requested the service is liable for payment of the invoice. We accept personal and company checks, money orders, bank checks and VISA/Mastercard.

Finance Charges
All invoices not paid within thirty (30) days are assessed a finance charge of 1.5% per month or 18% per year, compounded monthly. Separate finance charges and terms may apply for customers approved for the financial program and/or for other credit terms.

Disputed Charges
All disputes regarding services or charges for those services must be made in writing within (30) days of the customer's receipt of the invoice for those services. All written disputes must have a copy of the disputed invoice attached. Disputes not made in the above-referenced manner will be deemed a waiver of any future dispute regarding the same and an acceptance of the services rendered thereunder.

Jurisdiction.
Any agreement to provide services by APS shall be governed by the laws of the State of Minnesota.  Any disputes arising out of the terms contained in any invoice and/or the services rendered pursuant to the same shall be governed by the laws of the State of Minnesota.  Any party to this agreement shall be subject to the jurisdiction of the courts of the State of Minnesota.

Attorneys' Fees and Costs.
All costs and attorneys' fees incurred in the collection of any sums due and owing on any invoice shall be borne by the customer.
